Terms of Service

These Terms of Service (the "Terms") govern your use of GenerateBizPlan (the "Service"), a free AI-powered tool that generates a 1-page Lean Business Canvas PDF, operated by Mill AI sp. z o.o. ("Mill AI", "we", "us"). By using the Service, you ("User", "you") agree to these Terms in full. If you do not agree, do not use the Service.

1. Acceptance of terms

You accept these Terms when you (a) check the consent box before generating a canvas, or (b) otherwise access or use the Service. These Terms form a binding agreement between you and Mill AI sp. z o.o.

2. The Service

GenerateBizPlan is a free web application that takes a short form about your business idea, sends your inputs to a generative AI model (Claude Haiku 4.5 by Anthropic), and emails you a 1-page Lean Business Canvas in PDF format. The Service is offered free of charge, without a paid tier, for planning and brainstorming purposes.

3. AI disclaimer — READ FIRST

By using the Service you acknowledge that you have read, understood, and accepted this disclaimer. The Service requires you to tick a consent box confirming this acknowledgment before any canvas is generated.

4. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service you represent that you are legally able to enter into binding agreements. The Service is available globally, but some features may be restricted based on local law; you are responsible for compliance with the laws of your jurisdiction.

5. Acceptable use

You agree NOT to:

• submit content that is illegal, defamatory, harassing, obscene, or infringing of intellectual property rights;
• submit personal data of third parties without their consent;
• attempt to exploit, reverse-engineer, or manipulate the AI model (prompt injection, jailbreaks, extraction attacks);
• automate access to the Service, scrape, or use bots without prior written permission;
• circumvent rate limits or abuse-protection mechanisms;
• use the Service to generate content for illegal, fraudulent, or deceptive business schemes;
• impersonate Mill AI, its employees, or any other person or entity;
• resell, rebrand, or commercialize the Service or its output as if it were your own tool.

We reserve the right to throttle, block, suspend, or terminate access for any User who violates these rules, at our sole discretion and without notice where necessary to protect the Service.

6. Intellectual property

6.1 Your inputs and outputs

You retain all rights to the text you enter into the form ("Inputs") and to the generated canvas you receive ("Output"). We claim no ownership of your business idea or the generated content.

6.2 The Service itself

The Service (software, design, brand, copy, templates, prompts) is owned by Mill AI and protected by copyright, trademark, and other intellectual property laws. You receive a personal, revocable, non-exclusive, non-transferable license to use the Service for lawful planning purposes only. You do not receive any license to copy, modify, or redistribute the Service itself.

7. No model training on your data

Your Inputs are sent to Anthropic's Claude API under a contract that excludes them from any model training pipeline. We do not use, share, or sell your Inputs or Outputs for AI training, data-enrichment, or advertising purposes. We may use aggregated, anonymized, and irreversibly de-identified usage statistics (e.g., "average session length", "% of users from Europe") to improve the Service.

8. No warranty

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted availability, or results. We do not guarantee that the Service will be free of errors, that the AI output will be accurate or suitable for any specific purpose, or that any business idea generated, inspired, or informed by the Service will be successful.

9. Limitation of liability

To the maximum extent permitted by applicable law:

• Mill AI, its officers, employees, partners, and processors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Service, including (without limitation) lost profits, lost data, lost business opportunities, reputational harm, or emotional distress — even if advised of the possibility of such damages.
• Our aggregate liability to you, for any claim arising out of or related to the Service, is limited to the greater of (a) EUR 0 (zero) — because the Service is provided free of charge — or (b) the minimum amount required by mandatory consumer-protection law in your jurisdiction.
• You are solely responsible for any decisions you make based on the AI output. Nothing in the Service constitutes financial, legal, tax, investment, or professional advice.

Nothing in these Terms limits liability that cannot be limited or excluded under applicable law (e.g., for gross negligence, willful misconduct, or death/personal injury caused by our negligence).

10. Termination

You may stop using the Service at any time. We may terminate or suspend your access to the Service (or any feature) at any time, with or without cause, with or without notice, especially if we detect abuse or a violation of these Terms. Sections that by their nature should survive (IP, disclaimers, liability, governing law, dispute resolution) will survive termination.

11. Governing law

These Terms are governed by the laws of the Republic of Poland, excluding its conflict-of-law rules. If you are a consumer resident in the European Union, you benefit additionally from any mandatory provisions of the law of your country of residence.

12. Dispute resolution

Before filing a legal claim, you agree to contact us at contact@millai.eu and attempt good-faith negotiation for at least 30 days. If a dispute cannot be resolved, you may:

• use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr (for EU consumers);
• refer the dispute to mediation (e.g., through the Polish Trade Inspection, WIIH);
• bring the dispute to the competent court. The court of general jurisdiction for Mill AI sp. z o.o. shall have jurisdiction, without prejudice to your rights as a consumer to bring the action before the courts of your place of residence.

13. Changes to terms

We may update these Terms to reflect changes in our Service, applicable law, or business practices. Material changes will be announced at least 14 days in advance via a banner on generatebizplan.com and, for registered email subscribers, by email. Continued use of the Service after the effective date of a change constitutes acceptance of the revised Terms. If you do not accept changes, your sole remedy is to stop using the Service.

14. Miscellaneous

• Severability. If any provision of these Terms is held invalid, the remaining provisions continue in full force.
• Waiver. Failure to enforce a provision is not a waiver of that provision.
• Assignment. You may not assign these Terms; we may assign them to an affiliate or successor in interest.
• Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Mill AI regarding the Service.
• Force majeure. We are not liable for failures caused by events beyond our reasonable control (e.g., outages of upstream providers, natural disasters, acts of authority).
• Language. These Terms are available in English and Polish. In the event of conflict, the English version prevails for non-Polish-resident Users; the Polish version prevails for Users resident in Poland, to the extent required by Polish consumer law.
